Old Business / Carryover Items:
New Business / Discussion Items:
- Should Renters/Tenets be named on accounts instead of Members?
- DWA Bylaws define Membership as available to property owners but do not address properties occupied by someone other than the Member.
- Applicable DWA Bylaws (https://www.docktonwater.org/wp-content/uploads/2023/08/Bylaws-as-revised-August-17-2023.pdf)
- 1.1. QUALIFICATIONS. Any person qualified to own real estate in the State of Washington and who has legal or equitable title to or evidence of title to any portion of land within the area served by the Dockton Water Association, shall, upon application for membership and tender of the current membership fee, or such other fees as may, from time to time, be approved by vote of the Board of Directors of the corporation, be admitted to membership in the corporation.
- 1.7. MEMBERSHIP OWNERSHIP. A membership is assigned to a specific property and transfers with that property upon change of property ownership only when all outstanding water bills charged to that property have been paid. Transfer to another property is not allowed, regardless of ownership, except when approved by the Board of Directors.
- Applicable DWA Bylaws (https://www.docktonwater.org/wp-content/uploads/2023/08/Bylaws-as-revised-August-17-2023.pdf)
- Other water providers are mixed; Heights Water and Tacoma Public Utilities permit a named occupant on accounts but Maury Mutual, Water District 19 and City of Seattle seem to restrict accounts/membership to property owners:
- Heights Water Bylaws X.7: All billings for fees and water usage shall be made to the owner of the water share, unless the owner requests another billing arrangement that is acceptable to the Corporation. (https://static1.squarespace.com/static/5ea1e2071c9c5f7420ff4176/t/5ebaf000da0a483fc75c710e/1589309441296/HEIGHTS+WATER+BY-LAWS+4-08.pdf)
- Maury Mutual Water Company Bylaws XI: Such membership shall be attached to a specifically described real property to be set forth in the application and shall entitle the owner thereof to water service only upon the property described. Said membership shall be transferable only upon the passing of title to the real property to which it is attached, and upon the passing of the title, the membership shall automatically follow such title and vest in the grantee, devisee, or assignee, provided, however, in the event of division of any property to which any such membership shall be attached, the owner of such membership shall elect and designate to which portion of such divided property it shall thereafter be attached. (https://maurymutual.org/wp-content/uploads/2017/07/MMWC-By-Laws-april-2016.pdf)
- Water District 19: Bylaw Article III.v) HOW TO OBTAIN WATER SERVICE. Property owners within the current boundaries of Water District 19 can petition the District for water service. (http://www.water19.com/wp-content/uploads/2022/08/Master-Resolution-FINAL-062022.pdf)
- Seattle: “In Seattle, tenants can have their own accounts for electricity, but the building landlord must manage the accounts for water, sewer, garbage, recycling, and food & yard (compost) disposal.” (https://www.seattle.gov/utilities/multi-family-properties)
- Tacoma: “Is there a fee to start or stop service? There is no fee when the utility service is moved from the tenant’s name to your name or a property manager’s name, as long as the service is covered by a Landlord Service Continuation Agreement.” (https://www.mytpu.org/ways-to-save/rental-property-resources/multifamily-condo-faqs/#pattern_6)
- DWA may wish to consider whether to amend Bylaws to permit other named individuals on accounts for billing purposes; could be put for a vote for 2025 Annual Report & Meeting.
- DWA Bylaws define Membership as available to property owners but do not address properties occupied by someone other than the Member.
